Your Deed Is Real, But Is It Registered?

People tend to treat the deed in the drawer as the final word on ownership. It is not. Ownership of land and houses in Zimbabwe is decided by one thing: who is recorded as the owner on the live register at the Deeds Registry. A deed can be entirely genuine and still not place you there, usually because the transfer step was never completed. What registered really means

When a property is sold, ownership does not pass when you pay, or when you move in, or when you receive a deed. It passes when a conveyancer lodges the transfer and the Registrar registers it in your name. Until that happens, the register still shows the previous owner, and in the eyes of the law they remain the owner. The deed you hold is a record of the register, not a substitute for it.

Four ways a genuine deed can still leave you short

1. Transfer was never completed. You paid and took occupation, but the deed still names the previous owner because transfer was never lodged. You hold a contract, not registered ownership. This is the same trap explained in Cession Is Not Ownership.
2. You hold a copy, the register holds the truth. Your deed is only a snapshot. What governs ownership is the current entry at the Deeds Registry. If the two ever disagree, the register wins.
3. The title is real but burdened. A properly registered deed can still carry a mortgage bond, a caveat or a restrictive condition you were never told about, each of which limits what you can do with the property.

How to know for certain

A deeds search settles it. It shows who is currently registered as owner and whatever is registered against the property. Whoever appears on that record is the owner the law recognises, full stop. This is also precisely the check the new SI 76 of 2025 validation will demand of every owner, so confirming it now, and fixing any gap, simply puts you ahead of the queue.
